Terms of Service

These Terms of Service ("Terms") govern your access to and use of the website at flashsetup.com and the services provided by Flash AI Setup LLC ("Flash Setup," "we," "us," or "our"). By using the Services or engaging Flash Setup as a client, you agree to these Terms.

1. The Services

Flash Setup builds and operates websites + GoHighLevel automation systems for mobile dog grooming businesses. Services include:

Design and development of a custom website hosted on your behalf;
Configuration of a GoHighLevel sub-account, calendar, automations, chat widget, and review funnel;
Setup, deployment, and basic ongoing support of the above.

2. Pricing & Cancellation

Fee: $0. The Services are provided free of charge during the current program (the "Free-for-Testimonial Program"). No payment is collected at any time. No card on file. No auto-billing.
Program scope: The Free-for-Testimonial Program is limited to the first ten (10) mobile dog grooming businesses to complete a build with Flash Setup. Once ten testimonials have been collected, the program closes and any future paid version of the Services will be offered under separate, then-current terms.
Your commitment: In exchange for the build, you agree to (a) record and send Flash Setup a video testimonial of approximately three minutes within thirty (30) days of the date your site goes live, and (b) leave one publicly visible Google review for Flash AI Setup LLC within the same window. You retain ownership of the testimonial recording and may post or republish it elsewhere as you wish.
Cancel anytime. You may cancel by emailing jason@flashsetup.com. Cancellation takes effect immediately. You may keep your website code and any data you have entered into the system. We may, at our discretion, take down the live site within seven (7) days of cancellation.

3. No Refund (Nothing Was Paid)

Because no fee is charged for the Services during the Free-for-Testimonial Program, there is nothing to refund. If a future paid version of the Services is offered, refund terms will be governed by the agreement applicable to that version at that time.

4. Your Responsibilities

Provide accurate business information, photos, and content required to build your site.
Maintain your own Google Business Profile, Stripe, social media, and any other third-party accounts.
Comply with all applicable laws and regulations governing your business.
Not use the Services to send unsolicited SMS, spam, or illegal content.

5. Ownership

You own the website code Flash Setup builds for you. We retain ownership of the underlying GoHighLevel automation templates, snapshots, and any pre-built components we re-use across clients. Upon cancellation, you may export your website files and any customer data you have in the system.

6. SMS / Text Messaging Terms

By providing your mobile number and affirmatively opting in via a Flash Setup form, you agree to these SMS Terms in addition to our general Terms of Service and Privacy Policy.

Program description.

Flash AI Setup LLC operates an SMS program that delivers: (a) appointment confirmations and reminders for booked discovery calls and consultations; (b) follow-up messages related to your inquiry or engagement; (c) operational, account, and service notifications; and (d) informational messages relating to web-design and marketing services you requested information about. This program is operated by Flash AI Setup LLC on behalf of Flash AI Setup LLC; we do not resell, sub-lease, or share access to this program with any other brand.

Consent.

Enrollment requires your affirmative, opt-in consent via an unchecked checkbox on a Flash Setup form, or via a verified two-way SMS opt-in. Consent to receive SMS messages is not a condition of purchasing any product or service from us.

Message frequency.

Message frequency varies. You can typically expect between 2 and 6 messages per month, though volume may increase during active engagements.

Costs.

Message and data rates may apply. Flash Setup does not charge a fee to send or receive SMS, but your wireless carrier may.

Opt-out (STOP).

You may cancel the SMS program at any time by texting STOP to the number from which you received messages. After you send STOP, we will send you one final confirmation. You will not receive any further messages unless you re-enroll. To re-enroll, complete the opt-in form again on our website.

Supported carriers.

The program is available on most major US carriers including AT&T, T-Mobile, Verizon Wireless, Sprint, Boost, US Cellular, MetroPCS, and others. Carriers are not liable for delayed or undelivered messages.

No guarantee of delivery.

SMS delivery is subject to effective transmission from your wireless service provider and is not within our control. We are not responsible for any delayed or undelivered SMS messages.

Eligibility.

You must be at least 18 years old and the authorized account holder or user of the mobile number you submit. You agree not to provide a mobile number that does not belong to you.

Privacy.

Our use of your mobile number and SMS opt-in data is governed by our Privacy Policy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.

Modifications.

We may modify or terminate this SMS program at any time, with or without notice, without liability to you.

7. Disclaimers

The Services are provided "AS IS" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. Flash Setup does not warrant that the Services will be uninterrupted or error-free, nor that any results will be achieved (e.g., specific lead volume or revenue).

8. Limitation of Liability

To the maximum extent permitted by law, Flash Setup's total liability for any claim arising out of or relating to these Terms or the Services shall not exceed the amount paid by you to Flash Setup in the 12 months immediately preceding the claim. Flash Setup will not be liable for any indirect, incidental, special, consequential, or punitive damages.

9. Indemnification

You agree to indemnify and hold Flash Setup harmless from any claim, loss, or damage (including reasonable attorneys' fees) arising from your use of the Services, your content, or your violation of these Terms or applicable law.

10. Governing Law

These Terms are governed by the laws of the state in which Flash AI Setup LLC is registered, without regard to conflict-of-laws principles. Any dispute shall be resolved exclusively in the state or federal courts located in that state.

11. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted here with an updated "Last Revised" date. Continued use of the Services after changes are posted constitutes acceptance.
